IN NO EVENT SHALL OG SMOKE AGENCY'S LIABILITY TO YOU FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY SERVICES PROVIDED ON THE SITE EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO OG SMOKE AGENCY IN THE 12-MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You shall indemnify and hold OG Smoke Agency, its affiliates, officers, directors, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with (a) your use of the Site or any services provided on the Site; (b) your violation of these Terms; or (c) your violation of any third-party rights.

10. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the County of Los Angeles, State of California, and you hereby consent to the personal jurisdiction and venue of such courts.
